We are Electrifying Ltd (Electifying), a UK based website for users that may be looking to purchase or already own an electric vehicle.

We are registered at Companies House under number 11841960 and with the ICO under number ZA804374.

Our role:

Electrifying typically acts as a Processor on behalf of automotive companies, allowing you to, for example, request brochures from them, book test drives or express an interest. When you do this on our website, we are working purely on behalf of the automotive company and pass your personal data straight to them. To understand more about how they process your data, you will need to contact them directly. Their privacy notice is available at the point you provide your data. The rest of this privacy notice does not apply to that processing.

We also act as a Controller of personal data. This is when you consent to providing your data to us to join our mailing list; or if we hold your data because we have, or would like to have, a contractual relationship with you (employee) or your company (client/supplier etc). When we are a Controller of your personal data, we determine the ways and means of processing your data and must therefore, be accountable for it. We are trusted to look after it and deal with it in line with both data protection law and this privacy notice.

Information we collect:

If you have signed up to receive emails from Electrifying, then we will hold the data you provided to us;  name, email address and sometimes area of interest. Our lawful basis for processing this data is consent for you to receive email communications, legitimate interest to process the data and legal obligation if you ask to opt you out of marketing, and we add the data to our suppression list. 

We process your data for email marketing purposes until you unsubscribe or if we have seen 2 years of inactivity e.g. emails not being opened.

We keep data on our suppression list indefinitely unless you specifically ask us to remove it.

To unsubscribe from our e-mail database or to opt-out of marketing communications, please contact us using the details above or opt-out using the link provided in the communication.

When you visit our website, and have consented to unnecessary cookies, our servers will, depending on the cookie, automatically log the standard data provided by your web browser. It may include your computer’s Internet Protocol (IP) address, your browser type and version, the pages you visit, the time and date of your visit, the time spent on each page, and other details.

We may also collect data about the device you’re using to access our website. This data may include the device type, operating system, unique device identifiers, device settings, and geo-location data.

Our lawful basis for this data processing is consent under the  Privacy and Electronic Communications Regulations (PECR) to drop the cookies and then legitimate interest to process the data. We have carried out a legitimate interest balancing test that shows that our interest does not infringe on your rights and freedoms as an individual with regards to data protection.

Necessary cookies are placed on your device to ensure the site works for the device you are on, and to ensure the security of our site. Our lawful basis for this is legitimate interest.

If you are a supplier  or a client of ours then we will hold your contact details, and correspondence with you (or your employer) for the length of time that we have a contract with you plus 7 years. Our lawful basis for this is that it is necessary for the performance of the contract. 

The employee privacy notice is available from our internal sites only. Potential employees will be provided with an applicant privacy notice on the site where they view our job advert.

Data Sharing and International Transfers:

When we are a Controller, we share your data with companies that act as our processors. That means we have a contract in place with them, committing them to ensuring the safe and secure processing of your data. They only operate on our instruction and do not use the data for their own purposes. This includes cloud storage providers and our accountancy software.

We do not transfer your data to any entities outside of the UK and EU. When we transfer to the EU it is done on the basis that the EU has an adequacy agreement with the UK, and your data is subject to equivalent laws there as it is in the UK.

We also share data where required with our accountants, auditors, and any time we are obliged to under UK law. 

As a Controller, we do not sell your data.


Your rights:

Your right of access - you have the right to ask us for copies of your personal information.

Your right to rectification - you have the right to ask us to rectify information you think is inaccurate. You also have the right to ask us to complete information you think is incomplete.

Your right to erasure - you have the right to ask us to erase your personal information in certain circumstances.

Your right to restriction of processing - you have the right to ask us to restrict the processing of your information in certain circumstances.

Your right to object to processing - you have the right to object to our processing your information if the legal basis is legitimate interests.

Your right to data portability - this only applies to information you have given us. You have the right to ask that we transfer the information you gave us from one organisation to another or give it to you. The right only applies if we are processing information based on your consent or under a contract, or in talks about entering one, and the processing is automated.

Complaints:

If you wish to make a data protection complaint, please contact us using the details below and provide us with full details of the issue. We will promptly investigate your complaint and respond to you, in writing, setting out the outcome of our investigation and the steps we will take to deal with your complaint. You also have the right to lodge a complaint about our processing with a supervisory authority — in the UK that is the ICO whose details are here: www.ico.org.uk 

Business Transfers:

We may, from time to time, expand or reduce our business and this may involve the sale and/or the transfer of control of all or part of our business. Any personal data that you have provided will, where it is relevant to any part of our business that is being transferred, be transferred along with that part and the new owner or newly controlling party will, depending on the lawful basis, be permitted to use that data only for the same purposes for which it was originally collected by us.

In the event that any of your data is to be transferred in such a manner, you will be contacted in advance and informed of the changes.

Changes:

We may change this privacy notice from time to time (for example, if the law changes). We recommend that you check this page regularly to keep up to date.

If we make any material changes to the way we process and use your personal data, we will contact you to let you know about the change.
